Northampton County; Court of Pleas and Quarter
Sessions;
September Term 1824
To the Worshipful the Justices of the County Court aforesaid
The Petition of Burwell Norwood & wife Elizat
formerly Elizabeth Glover shewith unto
your worships that Benjamin Glover the father
of your petitioner Elizabeth departed this
life in the County of Chatham in this State where he
resided sometime in the year 1798 seized and
possesed of a large real & personal estate having
previously duly made and published his last will and
Testament which was regularly admitted to probate in
Chatham County Court November Sessions 1798 &
thereby divised and bequeathed all his estate to his
wife Frankey during her natural life or
widowhood & after that to be equally divided between
his four children Elizabeth (your
petitioner), Wm, Williamson and Polly Glover and appointed his said wife
Frankey sole
Executrix to his said will, who qualified thereto &
took on herself the management & control of the
Estate of the Testator all which will appear on
reference to said will a copy of which your
petitioners have ready to exhibit to this Court..
Your Petitioners further represent that the said Franky the Executrix sold the perishable estate
of her Testator and also a negro woman for the sum
of five thousand dollars, or some other Large sum,
but failed to return any Inventory on account of
Sales to Court...That afterwards removed from
Chatham to Northampton Count, taking with her the
unsold part of the personal Estate amounting to Ten
Negroes or more and other property, and then
intermarried with one Laban Norwood of the
last mentioned County by act your petitioners
alledge that her interest in the estate of her first
husband ceased and determined & the devise & bequest
to the children of the Testator thereupon took
effect.. That upon the marriage aforesaid of the
said Laban he took in him in virtue of
marital rights the whole management & control of the
property of the said Benj. Glover decd &
kept possession of the slaves or recd their hires
collected the debts and made sale of property
amounting in the whole to three thousand dollars or
some other considerable sum that the said Laban
was shortly after his marriage appointed guard. by
the Court to your petitioner Elizabeth & to
the other children of the said Benjamin Glover
in that capacity leased or ought to have leased
the lands of the said children in Chatham and recd
or ought to have recd the rents for the same
together with the profits arising from their other
property which your petitioners charge amounted to
five thousand Dollars or some other sum. Your
petitioners further show that William one of
the children of the said Benjamin Glover has
settled with the said Labon Norwood for his share of
his fathers estate as they are informed, that Williamson
another child is a resident of the
state of Georgia & Polly another child has
intermarried with one Nathl Harris of this
County. Your petitioners have frequently demanded of
the said Laban Norwood and his wife Franky
an account & a settlement of the estate of the said
Benjamin Glover & also of his guardianship of
your petitioner Elizabeth & that he would
...& deliver to them whatever they might be entitled
to...But a complyance with his reasonable request
has been refused..Your petitioners therefore pray
your worships that proper proofs may issue to the
said Laban Norwood & wife Franky; William
Glover Nathaniel Harris & wife Polley & that
publications be made as to Williamson Glover and also that the said
Laban & wife may be
compelled to answer particularly to the several
allegations in this petition & more especially that
they may be decreed to exhibit an accurate & full
account of all their actings & doings in & about the
Estate of the said Benjamin Glover & to come
to a fair & equitable settlement with your
petitioners in their several capacities of Executrix
& Guardian as aforesaid & pay over to them whatever
may be found Justly due to them & that your
petitioners may have every other necessary & further
relief in the premises,-- may it please your
worships. J. Burges Atto.

These defendents to saving etc
for answer say that they admit
the death of Benjamin Glover
as set forth..& that he made
a last will as is stated to
which the defendant Frankey
qualified as executrix..& in
that capacity took into her
possession the personal estate
of her testator.. that she
returned to the County Court of
Chatham an inventory of said
property..that soon after the

more...& that the proceeds of
said sales were expended to
paying debts due upon the estate
of her testator & the support &
maintainance of the defendents &
her infant children..This
defendant Frankey also
admits that she removed from
Chatham to Northampton County..&
brought with her the remaining
negroes & the residue of the

being five in number...& one
soon after died...and that soon
after she intermarried with Laban Norwood
the other

this defendant and Laban
has been always ready to come to
a settlement with petitioners &
to pay whatever might be due..&
has repeatedly urged the
petitioner Burrill to
settle & adjust their claims &
that if any thing should be
found due sd Burritt (sic)
